Acceptable Use Policy

This Acceptable Use Policy (AUP), including the list of Prohibited Activities below, is an integral part of your Service Agreement with Momentum Hosting. If you engage in any of the activities prohibited by this AUP, we may suspend or terminate your account.

The AUP is designed to protect us, our customers, and the wider Internet community from irresponsible or, in some cases, illegal activities. It is a non-exclusive list of prohibited actions. We reserve the right to modify the Policy at any time, effective on posting at https://www.momentumhosting.com.au/legal/acceptable-use.

Prohibited Uses of Our Systems and Services

AUP-1. Transmission, distribution or storage of any material in violation of any applicable law or regulation. This includes material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorisation, and material that is obscene, defamatory, that constitutes an illegal threat, or that violates export control laws.

AUP-2. Sending Unsolicited Bulk Email (“UBE”, “spam”) through our servers is prohibited. Sending UBE from another service provider advertising a website, email address or resource hosted on our servers is also prohibited. Our accounts may not be used to solicit customers from, or collect replies to, messages sent from another Internet service provider where those messages violate this Policy or the other provider’s.

AUP-3. Advertising, transmitting or otherwise making available any software, product or service designed to violate this AUP or the AUP of any other Internet service provider. This includes facilitating unsolicited bulk email, phishing, flooding, mail-bombing, or denial of service attacks.

AUP-4. Operating an account on behalf of, or in connection with, or reselling any service to, persons or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) at spamhaus.org.

AUP-5. Unauthorised attempts to gain access to any account or computer resource that does not belong to you.

AUP-6. Obtaining or attempting to obtain service by any means or device with intent to avoid payment.

AUP-7. Unauthorised access, alteration or destruction of any information belonging to any of our customers or end-users, by any means.

AUP-8. Knowingly engaging in any activity designed to harass another user, or to cause a denial of service against another user, whether on our network or another provider’s network.

AUP-9. Using our services to interfere with the use of our network by other customers or authorised users.

AUP-10. Cryptocurrency mining, or operating any proof-of-work compute workload, whether for coin generation, block validation, or any related purpose, on our shared infrastructure.

AUP-11. Using our infrastructure to train, fine-tune, or run inference on machine-learning models where the training data has been scraped from third-party sites without permission, or where the model’s outputs are intended to reproduce or replace content the source did not licence for that purpose.

AUP-12. Operating a Tor exit node, or any other service designed to accept and forward anonymised traffic on behalf of unidentified third parties.

AUP-13. Running publicly reachable game servers (Minecraft, Counter-Strike, ARK, and equivalents). Shared hosting is not sized or shaped for these workloads and their resource profile is disruptive to other customers on the same server.

Limitations on Services Provided by Us

In addition to the requirements of this AUP or the Terms and Conditions, the Service may only be used in a manner that is consistent with its purpose. We will determine whether this is the case at our sole discretion.

To ensure our services operate as smoothly as possible, some limitations apply. These include, but are not limited to, the following.

Mail Services

Recommended maximum single message size. 20MB. This is a recommendation rather than a hard limit. Larger messages may be accepted, but SMTP delivery of very large attachments is generally unreliable, because most receiving mail servers reject or silently drop attachments over 20MB. For anything larger, use a file transfer service or a secure link.

Maximum mailbox size. No greater than the disk space allocated to your hosting account.

Web Hosting Services

Website traffic allowance. Traffic under the allowance provided by your plan is included. If your account’s traffic consistently exceeds the allowance, we will discuss moving you to a plan that fits, rather than applying automatic overage charges.

Server disk usage allowance. Disk usage under the allowance provided by your plan is included. Additional disk space is available on request. Talk to us and we will add it and quote the addition, rather than apply automatic overage charges.

Disk warnings. We monitor disk usage and will contact you if it crosses 80% of your allowance.

System resources. You acknowledge that the Service runs in an environment where multiple users share a finite pool of resources. You agree not to engage in any activity that would consume a disproportionate share of server resources.

Scripts and executables. You are responsible for ensuring that any scripts or executable files you upload are written and configured in a secure and reliable way. Support and maintenance of these scripts remain your responsibility unless otherwise stated in the terms of your Service. We may from time to time and without notice upgrade the software and hardware running on our servers. It is your responsibility to ensure your scripts continue to work as expected after these upgrades.

Additional Obligations

1. You must comply, in a timely manner, with any instructions or requests we make regarding the hosting of your website, your domain name or any other service.

2. Bulk email must provide recipients with an easy and effective mechanism for removal from the list. Senders of bulk email must confirm that the actual owner of each address on a list has agreed to receive bulk mail from the sender before sending. Purchasing address lists from third parties for mailing through any of our services, or referencing any of our accounts, is prohibited. Using our SMTP services to send bulk email is expressly prohibited unless otherwise agreed in writing. A daily outbound email limit applies to each domain to protect the shared IP reputation of the platform.

3. You are responsible for protecting your passwords and for any authorised or unauthorised use of our systems and networks. All actions resulting from a compromised password remain your sole responsibility.

4. You are responsible for all content or information residing on, obtained through, or transmitted via the Service. You must provide appropriate protection to prevent minors (persons under 18) from accessing any unsuitable material published via any Service. You must ensure that no content could be considered threatening, obscene, indecent, defamatory, or that could otherwise adversely affect any individual, group or entity.

Your Responsibility for Your Users

You are responsible for the activities of your users. By accepting service from us, you agree to ensure that your customers, representatives and end-users abide by this Policy. Complaints about your customers, representatives or end-users will be forwarded to your registered contact email address where possible. If you violate our AUP, we reserve the right to terminate your services or take action to prevent further violation, as we deem appropriate, without notice.

Revisions

• 15 July 2026. Full review and voice pass. Removed the 30-day email retention clause (never enforced). Rewrote the traffic and disk-usage sections to reflect that we do not apply automatic overage charges; additional disk is available on request. Removed the traffic warnings clause. Softened the 20MB message size from a limit to a recommendation. Added AUP-10 (cryptocurrency mining and proof-of-work), AUP-11 (AI training on unlicensed scraped data), AUP-12 (Tor exit nodes), and AUP-13 (public game servers). Fixed the intro URL to the current policy location. Minor typo and structural cleanup throughout.
